Published Patent Application

« Back to Glossary Index

Eighteen (18) months after the filing date of a patent application the United States Patent and Trademark Office (USPTO) will publish the application. Publication does not give the inventor any rights but informs the public of what the inventor has filed. At this point, the patent application is typically still pending at the USPTO. A fee can be paid to have a patent application publish earlier, or a request can be submitted so that the patent application does not publish at all.
