Continuation Application (CON)

A continuation patent application (“continuation” or “CON”) is a new patent application that follows an earlier-filed patent application. The continuation application uses the same specification as the earlier-filed patent application but usually includes different claims, is entitled to the priority date of the earlier-filed patent application, and must be filed while the earlier-filed patent application is pending. A continuation is required to have at least one inventor that is also an inventor on the parent application.
